Border Patrol Releases Gerardo Henao and Thousands of Others Amidst Asylum Processing Suspension; Deportation Flights Limited by Resources and Diplomatic Challenges

President Joe Biden suspended asylum processing at the US-Mexico border, leading to the arrest of Gerardo Henao from Colombia.
Instead of being deported, he was released at a San Diego bus stop due to limited resources and logistical challenges for the Biden administration to enforce the measure on a large scale.

The policy, which took effect on Wednesday, includes an exception for "operational considerations," acknowledging the government's lack of funds and authority to deport people from countries like Colombia, Asia, Africa, and Europe who have recently arrived at the border.

The Homeland Security Department has implemented a deportation ban affecting thousands of migrants from Colombia, Ecuador, El Salvador, Guatemala, Peru, and Mexico.

The department's document states that demographics and nationalities encountered at the border impact their ability to deport people.

Two senior officials reported that over 17 deportation flights have taken place, including one to Uzbekistan.

A 59-year-old Colombian migrant named Henao was among those deported and was informed about the ban after being picked up by Border Patrol agents.

The agents processed release papers for Henao, ordering him to appear in immigration court in New Jersey on October 23rd.

The agents did not press Henao about why he had fled Colombia.

On Thursday, at a San Diego transit center, Border Patrol released several busloads of migrants, including those from China, India, Colombia, Ecuador, Mauritania, Sudan, and Ethiopia.

The migrants underwent photo and fingerprinting procedures before being released.

A volunteer used a bullhorn to direct them to a light-rail platform for free transportation.

The border officials were instructed to prioritize detaining migrants based on their ease of deportation, with the highest priority given to those from countries with quick travel document issuance and lower priority to those from countries whose governments don't accept US flights.

Asylum is suspended when daily arrests for illegal crossings reach 2,500 and ends when they average below 1,500 for a week.

A memo obtained by the New York Post and confirmed by the Associated Press reveals that US Immigration and Customes Enforcement (ICE) is prioritizing deportation flights to Guatemala and Honduras due to limited resources and cooperation from these countries.

ICE conducted 679 deportation flights from January to May, with nearly 60% going to Guatemala and Honduras.

The Bipartisan Policy Center's Theresa Cardinal Brown explained that the government faces hurdles in detaining and removing people from countries that are uncooperative, and cannot detain them indefinitely.

In a given time period, there were a total of 98 flights to Colombia, Ecuador, and Peru to deport illegal immigrants.

However, this number is small compared to the tens of thousands entering illegally from these countries every month.

There were only 10 deportation flights to Africa, despite Africa being a major source of migration to the US.

There was only one deportation flight to China, despite nearly 13,000 Chinese migrant arrests.

Mexico is the easiest country for deportations due to its proximity, but Mexicans accounted for less than 3 of 10 border arrests in the last fiscal year.

Mexico also takes in up to 30,000 people a month from Cuba, Haiti, Nicaragua, and Venezuela, and some countries refuse deportation flights to avoid being overwhelmed themselves.

Price, a retired official, stated that the US does not have the authority to unilaterally send back citizens of other countries.

The process requires the agreement of the receiving country.
