Federal Judge Blocks Trump Administration's Effort to Expand Expedited Deportations

US District Judge Jia Cobb temporarily halts the expansion of fast-track deportations for undocumented migrants in the interior of the country.
A federal judge has issued an order blocking the Trump administration's efforts to expand the use of expedited removal for undocumented migrants detained within the United States.

US District Judge Jia Cobb, based in Washington, D.C., temporarily halted the government's plans to swiftly deport individuals who have entered the country unlawfully without first appearing before a judge.The decision is a significant setback for President Donald Trump's administration, which aimed to increase the number of deportations carried out annually, with a goal of reaching 1 million per year during a potential second term.

The administration argued that expanding the expedited removal process would help control immigration and reduce the backlog of deportation cases.

However, Judge Cobb contended that this approach infringed upon individuals' due process rights under the Fifth Amendment.The Trump administration had announced plans to expand the use of expedited removal shortly after taking office in January 2025.

This expansion targeted undocumented migrants who have been in the United States for less than two years and initially applied only to those apprehended within 100 miles of the border.

Prior to this expansion, expedited removal was primarily used at the border and only for individuals who had been in the country for less than 14 days.The American Civil Liberties Union (ACLU) and various immigrant rights groups have challenged the administration's efforts through legal action.

Judge Cobb's ruling acknowledges that the Fifth Amendment does not necessarily protect undocumented migrants from expedited removal, but it emphasizes the necessity of due process when expanding this practice to cover a larger population within the country's interior.In addition to blocking the expansion of expedited removal for undocumented migrants, Judge Cobb recently issued another ruling temporarily halting the Trump administration's efforts to apply fast-track deportations to individuals who entered the US through humanitarian parole.

The judge argued that Homeland Security exceeded its authority in attempting to expand expedited removal and highlighted concerns over the potential harm such actions could cause.This ongoing legal challenge reflects the broader debate surrounding immigration policy and the balance between enforcing immigration laws and respecting due process rights.

As the court case continues, it remains to be seen how these developments will impact the administration's overall immigration strategy.
