PRAGUE — Nikhil Gupta's petition against his extradition to the United States has been rejected by the Czech Constitutional Court.
Gupta faces charges by the US government for allegedly hiring a hitman to assassinate US-based Sikh separatist leader Gurpatwant Singh Pannun in New York.
The undercover federal agent, posing as a hitman, was paid one hundred thousand dollars by Gupta.
Gupta, currently jailed in Prague, awaits a final extradition decision from the Czech justice minister.
The charges could result in up to 20 years of imprisonment.
Additionally, US prosecutors in November 2023 accused Gupta of plotting to kill at least four Sikh separatists in North America.
Gupta, allegedly directed by an unnamed Indian official, was disowned by Indian authorities who denied any policy to support such actions.
India has labeled Pannun a terrorist, an accusation he refutes, advocating instead for Khalistan, a separate Sikh homeland.
The White House contacted India at a senior level regarding the plot, and the Indian government has initiated an investigation.
India's Supreme Court rejected Gupta's January plea for assistance, stating the matter is for the government to address.
